Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to condition(s) below: Breedlove Dehydrated Foods, 1818 N. MLK Blvd., Lubbock, Texas. For the period of time up to and including May 18, 2009, the employer did not ensure that employees wore seat belts while operating forklifts. Employees operated forklifts to transports finished products to the warehouse, load and unload trucks, lift potatoes bins to transport potatoes to the process and transport bins from the outside to the processing area. a) Nissan electric forklift #30, serial #E197860, located in the packaging area. b) Nissan electric forklift #35, serial #A961847, located in the warehouse. c) WFG gasoline forklift #50, serial #0302524109, model #CPQD25-R-K2SM-O, located in the receiving area. These conditions exposed employees to potential struck by and caught in between hazards.
