North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being burned by cooking oil: a)chip plant crunchy product line, the employer did not have standardized operating procedures for cleaning the cooker/lines and starting the system up after shut down. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is: 1.Develop standardized operating procedures and train employees in those procedures.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion because methods were not utilized to prevent combustible dust from becoming airborne: a)flour silo tower room - silos, sifters, dust collectors, and other equipment were not equipped with a ventilation system to capture the flour and the employer did not develop a method to prevent the escape of flour from the equipment into the surrounding environment. b)use tank/reimelt room - tanks, dust collectors, and other equipment were not equipped with a ventilation system to capture the flour and the employer did not develop a method to prevent the escape of flour from the equipment into the surrounding environment. c)elevator control room - the room and equipment was not equipped with a ventilation system to capture the flour and the employer did not develop a method to prevent the escape of flour from the equipment into the surrounding environment. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to comply with National Fire Protection Agency (NFPA) 61, "Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities" (2008), including, but not limited to: *10.3.1- A method to prevent the escape of dust from process equipment into the surrounding environment.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire and explosion because air material separators (dust collectors) were located inside the building and were not designed to minimize damage that would occur in the event of a dust explosion: a)flour silo tower room - dust collectors were installed inside the room and on the top of the silos which were not vented to the outside, did not contain an explosion suppression system, and were not designed to minimize damage. b)use tank/reimelt room - dust collectors were installed on the top of use tanks which were not vented to the outside, did not contain an explosion suppression system, and were not designed to minimize damage. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is: 1. Comply with National Fire Protection Agency (NFPA) 61, "Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities" (2008), including, but not limited to: *10.4.3- Dust collectors shall be located outside of buildings and shall be protected in accordance with Section 6.3 (NOTE: Dust collectors shall be permitted inside the buildings if the employer complies with one of five exceptions as stated in this Section.) 2. Comply with National Fire Protection Agency (NFPA) 69, "Standard on Explosion Prevention Systems" (2008). 3. Comply with National Fire Protection Agency (NFPA) 68, "Standard on Explosion Protection by Deflagration Venting" (2007)."

NOTE: Among other methods, one feasible and acceptable method to abate this hazard is: 1. Comply with National Fire Protection Agency (NFPA) 61, "Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities" (2008), including, but not limited to: *6.2.1- If a dust explosion hazard exists in rooms, buildings, or other enclosures, such areas shall be provided with explosion relief venting distributed over the exterior walls (and roof if applicable). 2. Comply with National Fire Protection Agency (NFPA) 69, "Standard on Explosion Prevention Systems" (2008). 3. Comply with National Fire Protection Agency (NFPA) 68, "Standard on Explosion Protection by Deflagration Venting" (2007).
