Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to increased risk of injury and death from not having seatbelts on forklift trucks: Workplace - Two gasoline powered forklifts, a Clark with serial number 60-355-6 and a Hyster with serial number B72738K, were not equipped with seatbelts when worn to lessen the risk of injury or death in the event of being thrown from the forklift during an accident. Among other methods, one feasible and acceptable abatement method to correct the hazard would be to install seatbelts on the two forklifts.
