Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employee
were exposed to a tipping hazard.
a)At Job site, (On surge/coal pile approximately 50' in height) employees
engaged
in pushing coal with bulldozer without wearing a seat belt. . On or about
01/21/09.
Among other, feasible and acceptable methods to correct this hazard
include,
but not limited to the following:
1. Train heavy equipment operators and ensure the proper use of restraint
system
while operating bulldozers as referenced in the CATERPILLAR, Operation and
Maintenance Manual, D9T Track-Type Tractor, Safety Section.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE
EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION
FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN
ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR
1903.19.CE

were exposed to a fall under inadequate illumination.
a)At Job site, (On surge/coal pile approximately 50' in height) employees
engaged
in pushing coal with bulldozer at night were not provided adequate
illumination.
On or about 01/21/09.
Among others, Feasible and acceptable methods to correct this hazard
include,
but not limited to the following:
1. Use safe practices when pushing to a drawhole. The double push method
should be used when pushing to the draw hole along with adequate lighting.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE
EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION
FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN
ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR
1903.19.CE
