Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized
hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an explosion/flash fire hazard:
a)Kitchen: An employee was injured when the manufacturer's instructions
were not
followed and metal pellets were placed in a Garland broiler oven at
approximately
500 degrees F, on or about 1/8/09.
NOTE: Among other methods, feasible and acceptable abatement methods to
correct this
hazard are to:
1.Develop procedures to be followed when the pellet warmer designed to
warm the
pellets as per the manufacturer's instructions is out of service.
2.Provide training to employees concerning the manufacturer's instructions
and
ensure comprehension of the hazards associated with heating the pellets
incorrectly.
3.Make available a back-up pellet warmer for situations when one pellet
warmer is
removed from service.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER
IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS
ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY
OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
