Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: (a) Location - Job Site, Genie S-85 Boom Lift: On or about 10/10/08, the employer did not ensure that the boom was not raised or extended unless the machine was on a firm, level surface. Among other methods, a feasible and useful method to abate this hazard is to ensure that the lift is level on a firm surface, using, if necessary, adequate pilings or other supports to ensure that the machine is level, as stated in the Genie S-80, S-85 Operators Manual with Maintenance Information, Fifth Edition, Third Printing.
