Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of asphyxiation and delayed rescue from a
confined space:
(a)Location - 235 Beacon Street, Newton, MA:
On or about October 20, 2008, employees entered a steam vault meeting the
requirements of a permit required confined space and the levels of oxygen
in the vault
were not evaluated to determine if entry would be safe.
(b) Location - 235 Beacon Street, Newton, MA:
On or about October 20, 2008, employees entered a steam vault meeting the
requirements of a permit required confined space and were not using a
chest or full body
harness to facilitate non-entry rescue.
(c) Location - 235 Beacon St., Newton, MA:
On or about October 20, 2008, employees entered a steam vault meeting the
requirements of a permit required confined space and were not using a
retrieval device
to facilitate non-entry rescue.
Among other methods, feasible means of abatement to correct this hazard
are:
1.  Develop, implement, and complete a confined space permit entry system
meeting the
requirements of ANSI Z117.1-2003 Section 5.
2.  Test air quality before entry and continuous air monitoring where
there is a potential
for oxygen deficiency or entry of toxic or hazardous air contaminants in
accordance with
ANSI Z117.1-2003 Section 6.
3.  Provide and ensure the use of an extraction system to facilitate
non-entry rescue of
entrants in the event of an emergency in accordance with ANSI Z117.1-2003
Section
12.2.
