Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to explosion/fire hazards:
(a)Jobsite, 115 Pace Street, Nanty Glo, PA:  On or about 12/3/08 an
employee was burned
when a fire occurred during the vacuuming of flammables from an
underground tank.  The
employee was using a 4" flexible pvc hose that was not bonded between the
vacuum truck and
tank.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to use a hose during the vacuuming of flammables that is constructed of
conductive material or
thick walled with imbedded conductive wiring so that there can be bonding
between the vacuum
truck and tank in accordance with the American Petroleum Institute (API)
"Safe Operation of
Vacuum Trucks in Petroleum Service", Sections 5.3.1, 5.3.2 and 5.4.1.1.
