Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing type hazards due to unintended operation:
a) Harsco Minerals, LLC., 359 North Pike Road, Sarver, PA 16055, employees
were operating
the Case 465 Skid Steer with a bypassed door safety interlock switch.
Among other methods, one feasible and acceptable abatement method to
correct hazards is to
replace the diode inserted in the wiring system with the manufactured door
switch.
In addition,
inspect all safety interlocks for proper operation prior to operating the
Case 465 Skid Steer as
referenced in the Case Skid Steer 465 operator's manual.

were exposed to struck by hazards:
(a) Harsco Minerals, LLC., 359 North Pike Road, Sarver, PA 16055:
Employees who were
operating the Case 465 Skid Steer were exposed to struck by hazards in
that they have not had
training in the safe and proper use of the machine; an understanding of
the Manual pertaining
to the features of the machine outlined in the operators manual; and the
safe use and function
of the machine controls.
Among other methods, one feasible and acceptable abatement method to
correct hazards is to:
formally train all employees who operate and maintain the equipment as
referenced in the Case
Skid Steer 465 Operator's Manual.
