North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)jobsite, platform used with a fork lift to elevate personnel was not secured to the lift's forks or mast. NOTE: Among other methods, one feasible means of abatement is to secure the platform to the fork lift's mast with a chain. b)jobsite, platform used with fork lift to elevate personnel did not have a proper standard guardrail in use on all sides of the platform. NOTE: Among other methods, one feasible means of abatement is to ensure that a guardrail is present on all sides of the platform with a toprail or equivalent at a height at 36 to 42 inches above the platform and a midrail at a height midway between the toprail and the platform.
