that employees
were exposed to being caught in or crushed by the backhoe loader or
backhoe loader load:
a)Construction Site 1403 Broad St. Phenix City:  Employer failed to train
the
employees in the safe operation of the John Deere 310G Backhoe Loader,
product identification number TO310GX936577, while moving materials about
the site.
b)Construction Site 1403 Broad St. Phenix City:  Employer failed to require
employees to wear the seat belt on the John Deere 310G Backhoe Loader,
product identification number TO310GX936577, while moving material about
the site.
Feasible and acceptable methods of abatement to correct this hazard
include,
but are
not limited to the following:
1)Conform to the requirements of the John Deere Operators Manual
omt191038 that states, "Use seat belt when operating machine.
Remember to fasten seat belt when loading and unloading from trucks
and during other uses."
2)Conform to the requirements of the John Deere Operators Manual
omt191038 that states, "Do not operate this machine unless you have
read the operator's manual carefully and you have been qualified by
supervised training and instruction.  Familiarize yourself with the job
site and your surroundings before operating.  Try all controls and
machine functions with the machine in an open area before starting to
work.  Know and observe all safety rules that may apply to your work
situation and your work site.
3)Conform to the requirements of ASME/ANSI B56. la-1989 Addenda to
ASME B56.1-1993 Safety Standard that requires the use of seat belts
and for manufacturers to develop a program to retrofit older models.
