Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from hazards that were causing or likely to cause death or serious physical harm. a. On or about 12/7/08, Metal Extraction Plant - a leach of scheelite ore with hydrochloric acid was conducted then and at times prior. Among other methods, one feasible and acceptable means of abatement is to address the hazards inherent to the processes; install hydrogen sulfide monitoring/alarm devices at various strategic locations inside of the process area which would detect and provide audible and or visual warning of a release; identify facility operations and chemicals that represent chemical reactivity hazards in the processes; implement a hazard management system to address chemical reactivity hazards; identify engineering and system(s) controls necessary to ensure worker safety by completing an assessment of process systems handling reactants, by -products, and/or un-reacted process components, and identify all vent streams from the reactor(s) and assure that they remain inside a closed system during normal operations, during system upsets, and maintenance activities.
