Public Law 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: struck-by and caught-in hazards while coupling terminal tractors to trailers. On or about November 21, 2008, employees were exposed to crushing and struck-by hazards while occupying the rear deck of a terminal tractor during trailer coupling operations. Among other methods, feasible and acceptable abatement methods to correct this included, but are not limited to the following: 1. Develop a training program for new terminal tractor operators that includes Operating Safety Rules and Practices established in ANSI/ITSDF B56.9-2007 4.15 Operator Training and or the safe operating practices established by the manufacture in the operators manual. 2. Ensure that all instructors of new terminal tractor operators are familiar with the operators manual for the unit in use during training. 3. Ensure that terminal tractor operators check the condition of the unit prior to operation and report any defects to the designated authority as established in ANSI/ITSDF B56.9-2007 5.4. 4. Ensure that a work rule is established that prohibits the riding on the deck of a terminal tractor. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903(d).ents
