employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
Employee(s) were lifted approximately 10 feet high using a Nissan
forklift, Model
#KCPH02A25PV, Chassis/Serial #KCPH02P907488 while standing directly on the
forks or on
a 40 inch  by 48 inch wooden pallet to retrieve stock.  The pallet was not
firmly attached to the
truck and was not provided with a guardrail system. Employee(s) were not
provided a fall
restraint/arrest system exposing them to fall(s) to concrete ground.
AMONG OTHER METHODS, feasible and acceptable abatement method(s) are as
follows:
1.Comply with the requirements of ANSI/ASME B56.1-2009, Part
4 - General Safety Practices, Subpart 4.17 Elevating Personnel.
2.Develop work rules prohibiting the use of a forklift and pallet to
lift unprotected personnel and enforce the use of the portable metal
stairs which were provided and available.
Abatement documentation is required for this item in accordance with 29
CFR 1903.19(d).
