Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling while climbing out of an scissor lift while it was elevated. (a) Location - 129 Ballard Street, Saugus, MA: On or about 12/09/2008, an employee was exposed to the hazard of falling while climbing out of and into a scissor lift while it was elevated. Among other means, one feasible means of abatement would be to read and follow the manufacturer's operational manual in which it states "never use the elevating assembly to enter or leave the platform".
