Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a drowning hazard: a) West Angle Dock - when securing and unsecuring motor launch stern lines, Pilots were exposed to falling in the water, on or about October 23, 2008. Among other methods, several feasible and acceptable methods to correct this hazard are to remove employees from the hazard by discontinuing the use of stern lines on motor launch boats, require that Pilots work behind a guardrail or other barrier, or require that Pilots wear life vests.
