Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to falls from elevations:
On January 29, 2009 and at times prior thereto at the jobsite located at
9847 Maumelle
Blvd in Maumelle, Arkansas Employees were observed to be exposed to fall
hazards
while working from a Caterpillar TH63  rough terrain forklift. The
employees were
working approximately 25 feet above finished grade without the benefit of
a fall
protection system. The basket the employees were working from had a guard
rail
approximately 42 inches above the floor of the basket and the basket had a
midrail.
However, the employee was observed standing on the midrail as he changed a
light
fixture.
Among other methods, feasible and acceptable means of abatement to correct
this hazard
are to: (1) Provide employees working in forklift mounted baskets with
personal fall
protection systems or prohibit employees from standing on the midrail. (2)
Comply with
ANSI B56.6-2005 Section 5.15.1, Safety Standard for Rough Terrain Forklift
Truck
Requirements for Elevating Personnel" In accordance with this standard,
employees are
required to maintain firm footing on the platform floor unless secured by
body belt and
lanyard.

exposed to falls and stuck by hazards:
On or about January 29, 2009 at the jobsite located at 9847 Maumelle Drive
in
Maumelle, Arkansas, employees were working from a personnel platform
mounted on
a Caterpillar rough terrain forklift and the platform was not secured to
the forks, a
condition that exposed the employees to the hazards of falls from
elevation and to the
hazard of being struck by the platform in the event it slipped off the
forks.
Among other methods, one feasible and acceptable means of abatement is to
comply with
the requirements of ANSI B56.6 Section 5.15.1 "Safety Standard for Rough
Terrain
Forklifts" which states: Be certain that the platform is securely attached
to the lifting
carriage and forks.
