Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and deflagration: On or about March 17, 2009, and at times prior thereto, at the facility located at 801 North Jefferson, Springdale, Arkansas, the employer did not ensure that the magnet installed on Hammermill #2, was capable of removing all metal from the material being processed, as required by NFPA 664, Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, 1993, Chapter 4, Section 4-2, Metal Scrap, which states: "Provisions shall be made for separately collecting and disposing of any metal scrap, such as nails, band iron, or any wood containing metal, so that it will not enter the wood handling or processing equipment, the dust collecting system, or the scrap wood hog, exposing employees to the hazards of fire and deflagration. Among other methods, two feasible and acceptable abatement methods to correct this hazard are: (1) to ensure that magnets are capable of removing tramp metal from the material prior to entering processing equipment, such as Hammermill #2, or (2) remove the metal prior to further processing.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards: On or about March 17, 2009, and at times prior thereto, at the facility located at 801 North Jefferson, Springdale, Arkansas, the employer did not ensure that high speed abort gates or deflagration vents were used to divert sparks and burning material before entering the bag system, as required by NFPA 8.2.2.2.3, which states: "Metal ducts shall be protected by a listed explosion suppression system that has a design strength exceeding the maximum reduced deflagration pressure. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that either high-speed abort gates or deflagration/explosion vents are installed in duct work conveying combustible dust from a potential source of ignition, such as Hammermill #2, to the dust collecting system.
