Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard and caught-between hazard when operating an
aerial-lift positioned
on a slope greater than five degrees.
A JLG model number: 800 AJ was being operated on a slope greater than five
degrees during
a roofing job at United Methodist Church located in Kirkwood, Missouri.
Per ANSI A 92.2-1969 section 3.1.6(Stability on slopes) states: " Each
aerial device, when
properly mounted upon a vehicle meeting the manufacturers's minimum
vehicle specifications,
and used in a specific configuration, shall comprise a unit capable of
sustaining a static load, one
and one-third times the rated capactiy for that specific configuration, in
every
position in which
the load can be placed within the definition of the specific
configuration, when the vehicle is on
a slope of five degrees downward in the direction most likely to cause
overturning..".
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful.  The abatement
certification sheet is enclosed with the citation(s).
