employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that, the use of seat belts by employees operating forklifts
was not enforced,
exposing employees to crushing injuries in the event of a forklift
tip-over or other accident:
(a) Operators of electric powered forklifts were not wearing seat belts
while stocking the
warehouse and loading trucks with various beverages.
