Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a caught by hazard: At Statewide Tree & Landscape, Inc. employees were exposed to the hazards involving operations in the tree trimming and removal services. Employees performing operations of the wood chipper were exposed to being struck by and /or caught in the chipper fed hopper. The employer failed to ensure safe work practices were being performed by exposed employees. On or about 05/01/09, a chipper operator sustained serious injuries while feeding brush, tree debris, bark and other tree remnants into a Bandit Intimidator chipper. The victim became entangled in the winch rope resulting in his death. Among other methods, one feasible and acceptable abatement method: 1) Develop and implement written safe work practices in hazard recognition in the tree removal and trimming industry. 2. Train employees on the hazard recognition and safe work practices in the tree trimming operations, to include, but not limited to: a) Prohibit deployment of the winch rope while feeding the chipper b) Operator position to the side of the chipper during chipper feeding c) Maintain a safe watch personnel(standby) during chipper feeding d) Secure winch rope during chipper feeding on a storage hook. e) No brush feeding into the chipper in the front of the fed tray ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
