Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of potential fire
and explosion because
air material separators (dust collectors) were not designed to minimize
damage that would occur
in the event of a combustible dust explosion inside the machine:
(a) Polyethylene pellet grinding area- The Farr Company, Tenkay, Mark IV
dust collector with
a volume greater than 8 cubic feet was located inside the building and did
not meet the
protection, venting, or size requirements for inside use.  The dust
collector is used to collect
polyethylene resin dust, a combustible dust, generated during the pellet
grinding process.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method
to correct these hazards is to comply with the National Fire Protection
Agency (NFPA) 654,
"Standard for the Prevention of Fire and Dust Explosions from the
Manufacturing, Processing,
and Handling of Combustible Particulate Solids" (2006),  including, but
not limited to:
* Relocate the dust collector to the outside of the building.
* Develop and implement policies that meet the protection, venting and
size requirements
listed in Paragraph 7.13.1.1.2 of NFPA 654.
