Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employmnent and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
a)Yard Area - The employer failed to provide a means to eliminate or reduce
employee exposure to falling cargo such as installing posts, shoring bars,
stakes,
or a combination there of around the sides of the rollback flatbed truck
while it
was being manually unloaded.  An employee was struck when two pieces of
steel
plates slid off the side of the flatbed truck weighing approximately 400
to 500
pounds.
Among other methods, one feasible and acceptable abatement method:
1. The employer failed to keep the workplace free of a hazard: The
employer failed to
ensure that an employee was protected from a struck-by hazard.
2. The employer failed to provide a means to eliminate or reduce employee
exposure to
falling cargo by installing  posts, shoring bars, stakes, or a combination
there of along
the sides of the rollback flatbed truck while it was being manually
unloaded.
3. The hazard of unloading or transporting cargo in an unsecured manner is
addressed
by the U.S. Department of Transportation regulation 49 CFR 393.106(b),
general
requirements for securing articles of cargo. The employer stated that he
was aware of the
hazards of unloading cargo without the stanchions being installed and that
normally steel
stanchions were installed along the perimeter of the rollback truck bed to
prevent the
cargo from falling not only in transit but also when being off loaded. The
company owns
steel stanchions, stake poles, for the rollback flatbed truck. However,
they were not in
use on the day of the accident.
4. A feasible means of abatement to eliminate the hazard would have been
to install the
steel stake poles before tilting the bed to off load the cargo.
