Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The employer failed to ensure that seat belts or other safety restraints were utilized on two forklifts to safely secure employees in position while driving the forklift(s), thereby exposing employees to the hazard of being ejected. Among other methods, one feasible and acceptable method to correct the hazard is to install a seat belt assembly as referenced by the American National Standards Institute, ANSI B56.1. and offered by the forklift manufacturer as a retrofit item. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.TION
