Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards in the event of a loss of load while operating an underhung hoist/crane that is not inspected on a regular basis: (a) Location - Establishment On or about 1/27/09, the Budgit and Dayton underhung hoists used to lift piano parts were not subject to regular inspections. Among other methods, one feasible and acceptable method to correct this hazard is to establish and implement a program of frequent and periodic inspections in accordance with the requirements of ASME B30.16-2003, American Society of Mechanical Engineers Safety Standard, Overhead Hoists (Underhung), Section 16-2.1: Inspection. *** Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
