Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to struck-by hazards of moving vehicle(s):
On or about December 18, 2008, an employee walking in the north parking
lot outside
the maintenance shop bay was exposed to vehicular struck-by hazards. A
tractor trailer
was driven in a reverse direction out of the maintenance shop bay without
a clear view
to the rear and no methods were in place to ensure pedestrian safety.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHODS TO
CORRECT THIS HAZARD ARE:
a) Install an audible backup alarm that is distinguishable from other horn
signals and can be
heard above the surrounding noise level;
b) Only allow trucks to back out of the shop with an observer/spotter who
ensures
for the
duration that it is safe to do so;
c) Install barriers to prevent pedestrian traffic in areas where/when
trucks are backing out of the
shop.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
