Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall and being struck by hazards:
Employee/foreman operating the New Holland skid steer loader allowed
another employee to
stand in the bucket of the skid steer while it was being operated on a
city street. Employee
acting as the rider was exposed to injuries associated with falling and
being run over by the skid
steer.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS:
a) Train all employees/operators in the proper use of the skid steer
loaders and ensure
compliance with all of the safety guidelines that are outlined in the
operator manual for the New
Holland, Model L 869, Skid Steer, which prohibits personnel/employees from
riding in the
bucket.
29 CFR 1903.19(c)(1) requires certification that the abatement of the
above violation is
completed.
