certificada
Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
(#2820000369519564) el 17 de marzo de 2010.
9.Que una inspeccion de seguimiento comenzo el 8 de abril de 2010.
10.Conforme a la Seccion 25, parrafo (d) de la Ley 16 del 5 de agosto de
1975, segun
enmendada:
"(d) Cualquier patrono que deje de corregir una violacion para la cual se
haya emitido una
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
citacion bajo la Seccion 19(a) dentro del periodo permitido para su
correccion (el cual no debera
empezar a transcurrir hasta la fecha de la orden final del Secretario en
el caso de un
procedimiento de revision bajo la Seccion 20(c), iniciado de buena fe por
el patrono y no solo
para demorar o evadir las penalidades) podra ser multado civilmente con
una cantidad que no
excedera de siete mil (7,000) dolares por cada dia en que esa omision o
violacion continue".
11.Que 12 dias laborables o 20 dias calendario pasaron luego de la fecha
de correccion (19
de marzo de 2010) y hasta la fecha de inspeccion de seguimiento (8 de
abril de 2010).
12.Que la citacion original establecia el siguiente hecho:
En el Departamento de Educacion Escuela Petra Roman Vigo localizada en
Carolina, se
observaron empleados caminando en un piso desnivelado debido a que las
lozas estaban sueltas
y habian sido removidas en algunas areas.  En la entrada de la oficina del
director, las lozas se
salieron del piso, el area afectada del piso tiene 7 pies 6 pulgadas x 2
pies 2 pulgadas en
dimensiones y en el area de la impresora, 2 pies 1 pulgada x 1 pie 6
pulgadas de dimensiones.
Un metodo para disminuir el riesgo: Reparar todas las lozas rotas o
colocar algo en las areas
para nivelar el piso.
Riesgo: Empleados expuestos a caidas y tropiezos.
13.Que el hecho observado durante la inspeccion de seguimiento fue el
siguiente:
En el Departamento de Educacion Escuela Petra Roman Vigo localizada en
Carolina, se
observaron empleados caminando en un piso desnivelado debido a que las

y habian sido removidas en algunas areas.  En la oficina del director,
cerca del area de las
ventanas, las lozas se salieron del piso; el area afectada del piso tiene

dimension.

that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
DE Escuela Petra Roman Vigo failed to abate citation 01, Item 001  of the
inspection #
312813223, issued on February 23, 2010 and became a Final Order of the
Secretary. Failure
to abate is identified according to:
1.The date on which the employer received the citations,  February 24,
2010, date verified
on the mail receipt 70073020000059596346 signed by an employer
representative;
2.According to Section 20, paragraph (a) of Act No. 16 of August 5, 1975
as amended:
"If, after an inspection, the Secretary, or his authorized representative,
issues a citation under
Section 19 (a), he shall, within a reasonable time after the termination
of such inspection or
investigation, notify the employer by registered mail or other means of
delivery, of the penalty,
if any, he intends to assess under Section 25.  The employer shall have
fifteen (15) days,
excluding Saturdays, Sundays and holidays, from the receipt of the notice
of the citation, to
notify the Secretary that he wishes to contest the citation.  The employer
shall have also a period
of fifteen (15) days, excluding Saturdays, Sundays and holidays, from the
receipt of the notice
of the citation, to notify the Secretary that he wishes to contest said
assessment of penalty.  If,
within the aforesaid fifteen (15) days from the receipt of the citation or
notice of the proposed
penalty issued by the Secretary, the employer fails to notify the
Secretary that the intends to
contest the citation or the proposed assessment penalty, and no notice is
filed by any employee,
employees or representative of employees under subsection (c) within said
periods of time, the
citations and/or assessment of the penalty, as proposed, shall be deemed
to be a final order of
the Secretary and shall not be subjected to judicial review."
3.The fact that, fifteen (15) working days elapsed after February 24, 2010
and until March
17, 2010 and the citations and proposed penalties became a Final Order on
March 17, 2010.
4.That the abatement date on the citation was March 19, 2010.
5.That the employer did not request an extension for the abatement date;
6.That no employee, employees or representatives filed a notice under
subsection (c) within
said periods of time.
7.That the employer did not contest the citation or the proposed
assessment
of penalty of
inspection # 312813223.
8.That PR OSHA tried to obtain a response from the employer through a
certified letter
#70092820000369519564 (March 17, 2010).
9.That a follow up inspection began on April 8, 2010.
10.According to Section 25, paragraph (d) of Act No. 16 of August 5, 1975
as amended:
"Any employer who fail to correct a violation for which a citation has
been issued under Section
19 (a) within the period allowed for its correction (which period shall
not begin until the date
of the final order of the Secretary in the case of a review proceeding
under Section 20 (c)
initiated by the employer in good faith and not solely to delay or evade
the penalties) may be
civilly fined not more than seven thousand (7,000) dollars for each day
during which such failure
or violation continues."
11.That 12 working days or 20 calendar days has passed after the abatement
date, March
19, 2010 and until the follow up inspection date, April 8, 2010.
12.That the original citation stated the following facts:
At the Department of Education Petra Roman Vigo middle school located in
Carolina, employees
were observed walking on an uneven floor because the tiles were loose and
had been removed
in some areas.  At the entrance of the director's office, tiles had come
off from the floor, the
affected area of the floor had a 7ft-6in x 2ft-2in dimensions and at the
printer area 2ft-1in x 1ft-
6in dimensions.
One feasible method to abate the hazard: Repair all the broken tiles or
put something in the area
to level the floor.
Hazard: Employees exposed to fall and trips.
13.The facts observed during the Follow up Inspection were the following:
At the Department of Education Petra Roman Vigo middle school located in
Carolina, employees
were observed walking on an uneven floor because the tiles were loose and
had been removed
in some areas.  At the director's office area, close to windows, tiles had
come off from the
floor; the affected area of the floor had a 4ft x 3ft dimensions.
One feasible method to abate the hazard: Repair all the broken tiles or
put something in the area
to level the floor.
Hazard: Employees exposed to fall and trips.
DE Escuela Petra Roman Vigo fallo en corregir la citacion 01, Renglon 001
de la inspeccion
#312813223, emitida el 23 de febrero de 2010 y convertida en orden final
del Secretario.
El fallo en corregir se identifica de acuerdo a:
1.El dia en el cual el patrono recibio las citaciones, 24 de febrero de
2010; dia verificado
en el recibo del correo #70073020000059596346 firmado por un representante
del
patrono.
2.Conforme a la Seccion 20, parrafo (a) de la Ley 16 del 5 de agosto de
1975, segun
enmendada:
"(a) Si despues de una inspeccion o investigacion, el Secretario o su
representante autorizado
emite una citacion bajo la Seccion 19(a), debera dentro de un termino
razonable, despues de
terminada dicha inspeccion o investigacion, notificar al patrono por
correo certificado u otro
medio de entrega, de la penalidad, si alguna, que se propone imponer bajo
la Seccion 25. El
patrono tendra quince (15) dias, excluyendo sabados, domingos y dias
feriados, partir del recibo
de la citacion, para notificar al Secretario que el desea impugnar la
citacion. El patrono tendra
tambien un periodo de quince (15) dias, excluyendo sabados, domingos y
dias
feriados, a partir
del recibo de la notificacion de la propuesta penalidad, para notificar al
Secretario que desea
impugnar dicha imposicion de penalidad. Si dentro del periodo de quince
(15) dias antes
indicado, a partir del recibo de la citacion o notificacion de la
propuesta penalidad emitida por
el Secretario, el patrono deja de notificar al Secretario que se propone
impugnar la citacion o
la propuesta imposicion de la penalidad, y no se radica una notificacion
por algun empleado,
empleados o representantes de empleados, bajo la subseccion (c) dentro de
dichos periodos de
tiempo la citacion y/o la imposicion de la penalidad, segun propuesta,
seran consideradas como
una orden final del Secretario y no estaran sujetas a revision judicial".
3.Que el hecho que quince (15) dias laborables transcurrieron luego del 24
de febrero de
2010 y hasta el 17 de marzo de 2010 y las citaciones y penalidades
propuestas se
convirtieron en una Orden Final el 17 de marzo de 2010.
