Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to the hazard of being struck by lightning:
a) At the establishment, valet employees are exposed to the hazard of
being struck by
lightning during thunderstorms. The valets retrieve vehicles from open
parking lots and
bring them back to the service area during thunderstorms.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to develop and implement a written lightning policy that
incorporates the
following elements:
1.  Safety guidelines and procedures to be followed by all employees during
thunderstorms and/or when lightning hazards exist.
2.  Provide training to all managers and employees on the lightning safety
guidelines and
procedures.
3.  Utilize lightning detection devices such as personal lightning
detectors which emits
a audible warning sound before lightning is within striking distance.
Follow the flash to
bang method as a form of detection for fast approaching thunderstorms.
4.  Remove all employees from open areas such as parking lots in a timely
manner after
recognizing the threat of approaching thunderstorms.
5.  Implement an effective enforcement procedure.
