Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls: (a)At the construction site where employees were climbing onto the mid and top rail of the Sky Jack SJ III scissor lift serial # 3219 to gain access to the roof, exposing employees to the hazard of falls. Among other feasible and useful abatement methods to correct this hazard, one method would be to provide access to the working surface with an approved ladder.d
