Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of fall due to the tire rack system being
assembled with the required
clips which locks the railing to the post:
a)  At the site, in the tire storage area, an employee suffered a fall of
approximately 8
feet.  The employee was working on the second level of a tire rack system.
This system had
an approximately 4 foot wide opening near the right end of the system.
This opening had one
rail installed.  This rail gave way during the fall. The employer failed
to ensure that this rail and
all railing of the system were installed with the required locking clips.
Among other methods, one feasible and acceptable abatement method to
correct
the
hazard would be to inspect the tire rack system to ensure all rail and
post are locked together
with the required clips prior to allowing employee to work from the
system.e
