Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On 7/20/09 at the Perry Brooks Building, 720 Brazos, Austin, TX, employees were exposed to falls at an elevation of 125' while window cleaning from boatswain's chairs due to multiple deficiencies with the equipment and work practices utilized, such as, but not necessarily limited to the following: (1) operators were not equipped with and improperly utilized independent personal fall arrest systems, (2) equipment and components (i.e. boatswain's chair hardware and lanyards) with defects were not removed from service, and among other methods, one feasible and acceptable means of abatement would be to comply with the guidelines outlined in American National Standard/International Window Cleaning Association "Window Cleaning Safety" ANSI/IWCA I-14.1-2001. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
