Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falling:
a) On or about 10/07/09, at 2929 Pat Booker Rd, Universal City, TX 78148,
employee(s)
were exposed to the hazards of falling off an 8 ft fiberglass
self-supporting portable ladder,
placed against the wall, as an extension ladder to access a fixed metal
ladder on the side of the
building leading to the rooftop of a commercial building.  An approximate
3 ft gap was created
from the last rung of the metal fixed ladder to the top of the
self-supporting portable ladder
exposing the employee to a fall hazard.
b) On or about 10/07/09, at 2929 Pat Booker Rd, Universal City, TX 78148,
employee(s) were exposed to the hazards of falling off an 8 ft fiberglass
self-supporting
ladder, placed against the wall, incorrectly being used as an extension
ladder to access a
fixed metal ladder.  The fiberglass self-supporting ladder was improperly
used and set up
without following the manufacturers safety guidelines.
Among other methods, one feasible and acceptable abatement is to follow
ladder safety
procedures in accordance with provisions stipulated in ANSI A 14.5 2000
for Ladders-
Portable Reinforced Plastic-Safety Requirements, Section 9 and 10 as
applicable.  Also, an
extension ladder could replace the fiberglass self-supporting portable
ladder to access the
higher fixed metal ladder without creating a gap to prevent hazards of
falling.
