Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard from a wood pallet elevated on the forks of a powered industrial truck: a)169-197 River Road: An employee was exposed to a fall hazard of approximately 10 feet while working from a wood pallet elevated on the forks of a Komatsu powered industrial truck, on or about 10/07/2009. ABATEMENT NOTE: One feasible and acceptable methods of abatement, among other is to provide a safety platform used in accordance with ANSI B56.1 - 2005, 4.17 (elevating personnel) and 7.37 (platforms: elevating) or equivalent protection.
