Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall and struck by hazard due to collapse of aerial lift.
a) Parking lot area of job-site located at: 160 N. Main St., Lodi, NJ
07644. Employees were
using the boom of an aerial lift as a crane to hoist a light post.
Violation observed on or about
12/08/09.
Abatement Note: Among other methods, one feasible and acceptable method to
correct this
hazard is to follow the manufacturer's (JLG) Operation and Safety Manual
for the JLG aerial
lift 400s. Specifically but not limited to section 1 (safety precautions),
paragraph 3 (operation)
which describe the safety work practices related to this equipment. It is
mentioned in the manual
that: "Do not use the machine for any purpose other than positioning
personnel,
their tools, and
equipment." (page 1-3), "Do not push or pull any object with the boom."
(page 1-7), and
"Never attempt to use the machine as a crane. Do not tie-off machine to
any adjacent structure."
(page 1-7).
