Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevation: a)211 Hackensack Street, Wood Ridge, NJ: Two (2) employees were raised inside the bucket of a Deere 330C LC excavator approximately ten (10) feet above a concrete surface, on or about 02/08/2010. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to follow the Association of Equipment Manufacturers (AEM) Hydraulic Excavator Safety Manual HE03-02, which states, "Never use a bucket for a work platform or personnel carrier."
