Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the condition(s) listed below:
On or about July 2, 2009,  Midas Auto Service, 5115 S. Loop 289, Lubbock,
Texas, the
following hydraulic auto lifts in  the service bay area, were not in safe
operating condition:
a)  The Challenger brand lift on the East side of the service bay area
had a defective safety
arm/catch assembly, which allowed the lift to fall while in the elevated
position.
b) An unknown manufacturer, dual piston hydraulic lift, on the West end of
the service bay,
had no safety device to prevent piston movement while in the raised
position.

employees were exposed to the condition(s) listed below:
On or about July 2, 2009,  Midas Auto Service, 5115 S. Loop 289, Lubbock,
Texas, the
following hydraulic auto lifts in  the service bay area, were being
operated or were  available
for operation :
a)  The Challenger brand lift on the East side of the service bay area
had a defective safety
arm/catch assembly, which allowed the lift to fall while in the elevated
position.
b) An unknown manufacturer dual piston hydraulic lift, on the West end of
the service bay,
had no safety device to prevent piston movement while in the raised
position and "inched
down" from hydraulic fluid loss during use.
c) Four  Surface mounted lifts in center  bays
These conditions  exposed employees to struck-by or caught-between hazards
and were
observed on July 2, 2009.
Among other methods, one feasible and acceptable method to correct this
hazard is to
include, but not limited to the following: (1) Conform to the American
National Standards
Institute /Automotive Lift Institute Standard for Automotive Lifts -
Safety Requirements for
Operation, Inspection, and Maintenance, ANSI/ALOIM-2000, Section4.4.4.
The standard
includes,  but is not limited to the following guidelines: 1) Have lifts
inspected at least once
a year by a qualified inspector and maintain documentation of inspections.
2) Take out of
service those lifts that are in  need of repair. 3) Perform repairs  in
accordance with the
recommendations of the lift's manufacturer.4).Ensure that operators
operate the automotive
lifts only after being properly  trained.  Maintain training documents in
accordance with
ANSI/ALI ALOIM-2000, Safety Requirements for Operation, Inspection and
Maintenance,
Section 4 and Challenger Lifts Inc's Manufacturer's Manual.
