North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall to lower level. a)facility - where the employer failed to provide fall protection to exposed employees while walking and working on top of wooden crates located on flat bed trailers, exposed to a fall height of approximately 12 feet. b)facility - where the employer failed to provide fall protection to exposed employees while they were being lifted by a forklift to heights approximately 12 feet above the ground while standing on an unguarded pallet not secured to the forks. Among others, feasible and effective abatements would be to ensure the operator abides by the caution stated on page 11 of the Operator's and Owners Manual of the Toyota 5FGC20 Forklift: "Don't use a lift truck to raise people -- use a work platform or ladder".
