North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to uncontrolled felling of trees: a)highway right-of-way - where one employee felled two 6-inch diameter (measured at 6-feet above the ground) pine trees without any attempt to notch the trees or use a hinge to control the fall of the trees. Among other methods, one reasonable and feasible method of abatement is to apply an appropriate notch cutting technique on trees larger than 5-inches in diameter. Reference: ANSI Z133.1-1994, Paragraph 9.5.14., "Notches shall be used on all trees and trunks over 5 inches (12.5 cm) in diameter at breast height."
