North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from unsafe forklift operations: a)job site - no training was provided for one employee operating of the JCB, model #588-608, rough terrain forklift. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to train the operator in safe operation of the forklift. Reference:American Society of Mechanical Engineers (ASME) B56.6-1992, section 5.17.
