Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burns from potential dust explosions, deflagration and fire hazards caused by the improper design and maintenance of dust collection systems: a.)Shop - The dust collection system air flow was not sufficient enough to capture explosive wood dust as evidenced by the large amount of wood dust around the Giben panel saw and the general area, on or about February 3, 2010. b.)Shop - The collection bins for the Coral enclosureless dust collector were not being emptied daily, or more frequently if necessary, on or about February 3, 2010. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THESE HAZARDS IS TO FOLLOW THE REQUIREMENTS IN NFPA 664, STANDARD FOR THE PREVENTION OF FIRES AND EXPLOSIONS IN WOOD PROCESSING AND WOODWORKING FACILITIES WHICH INCLUDES BALANCING THE SYSTEM AND ENSURING THAT CAPTURE VELOCITIES ARE SUFFICIENT TO COLLECT ALL OF THE DUST GENERATED AND EMPTY THE COLLECTION BINS ON AT LEAST A DAILY BASIS.
