Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when using the Tommy Gate lifts to unload trucks: a)Materials Management Division, Morton Plant Mease - Employees unloading pallets of materials with pallet jacks rode the Tommy Lifts down with the loads (this practice is prohibited by the operating manual), on or about January 7, 2009. The employees had not been trained on the safe use and maintenance of the lifts. Among other methods, one feasible and acceptable abatement method to correct his hazard is to: obtain copies of the operators manuals and train the employees on how to use and maintain the lifts in accordance with the manuals; and, require employees to stand on the ground off to the side while operating the lift, as specified in the operators manual.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing and laceration hazard when using an improperly maintained Tommy Gate lift to unload a truck: a)Materials Management Division, Morton Plant Mease - There was a broken torsion spring on the Tommy Gate lift that had not been replaced or repaired prior to continued use of the lift, on or about January 7, 2009. Among other methods, one feasible and acceptable abatement method to correct his hazard is to: repair the broken torsion spring; maintain the lifts in accordance with the operators manuals; and replace warning and caution labels that are not legible (one of the warning and caution labels on the truck was not legible).
