Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards associated with a personnel platform: On or about June 21, 2010, an employee was exposed to fall hazards while working from a platform resting on the forks of a forklift because the platform did not indicate the maximum work load including personnel and equipment, the weight of the empty platform, or the minimum capacity of the truck on which the platform could be used. Among other methods, one feasible and acceptable abatement method to correct this hazard is to obtain and use a platform meeting the requirements of ANSI/ITSDF B56.1 - 2009, American National Standard Institute/Industrial Truck Standards Development Foundation Safety Standard for Low Lift and High Lift Trucks. MENARD, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 5(A)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 309840999, CITATION NUMBER 01, ITEM NUMBER 001, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 25, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 2221 STEVENS STREET, RHINELANDER, WI 54501. ***Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)***
