Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: On or About July 2, 2010, employees were exposed to crushing and struck-by hazards while placing and picking parts from the damaged racking system located in the Kitting Department and the employer had not removed the materials from the racks and had not repaired or replaced the damaged portion(s). Among other feasible method, one feasible and acceptable method to correct this hazard is to immediately unload visibly damaged racks until they can be repaired or replaced in accordance with ANSI MH16.1-2008, American National Standards Institute Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks. ***Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)***
