Nevada Revised Statute 618.375(1): Every employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer did not protect employees as follows: a.At 4600 Spring Mountain Road, on the south side of the building, employees used an unapproved scaffold platform attached to a rough terrain forklift to lift materials and to access the roof which was approximately 18 feet high, exposing the employees to hazards if the scaffold or forklift were to fail. It was not necessary for the rough terrain forklift to be used to lift the employees. The platform was open on the front side, lacking railings, and the employees did not use any type of restraining means such as a harness and lanyard. An employee entered the platform from the roof instead of at floor level. Reference ANSI/ITSDF B56.6-2005 part II for the user: Paragraph 5.15.1 - a rough terrain forklift shall not be used to lift people unless there is no other practical option. Paragraph 5.15.1(k) - be certain that required straining means such as railings, chains, cable, body belt(s) with lanyards(s), etc., are in place and properly used. Paragraph 5.15.1(w) - platform shall be lowered to floor level for personnel to enter and exit. One feasible means of abatement would be to follow the requirements of ANSI/ITSDF B56.6- 20056-
