Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure that compressed gas cylinders were stored away and not being tampered with as follows: a. At the basement level in the hallway next to the elevator, there was observed 5 Carbon Dioxide compressed gas cylinders. The cylinders were not secured and were subject to accidental tampering while employees were moving items that were stored next to them or walking in the hallway. Reference: Compressed Gas Association, Inc., P-1-1984, Section 3.5.8 Storage and use of containers. All compressed gas containers in service or in storage shall be stored standing upright where they are not likely to be knocked over, or the containers shall be secured. One feasible and acceptable abatement is to ensure that the compressed gas cylinders are secured to prevent accidental tampering.
