Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to maintain a safe or healthy place of employment as follows, a.An employee attempting to repair a malfunctioning satellite TV dish accessed the work area by using a stepladder which was placed on an unstable surface. The surface was the top of a skateboard ramp which was constructed of scrap wood material, which was in a state of disrepair, with wood that was deteriorated. While performing the work, the employee exited the ladder, and attempted to jump down from the top of the ramp, which was approximately three feet high, to the ground, which had scrap materials strewn about. The employee fell and suffered a broken fibula, tibia and severe ankle injuries. American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements A14.5-2000 9.3.4 Footing Support. - The ladder base shall be placed with a secure footing on a firm, level support surface. - Ladders shall not be placed on boxes, barrels, or other unstable bases to obtain additional height. 9.3.13 Setup and adjustment of ladders. 9.3.13.2 Stepladders The user shall ensure that the stepladder is fully opened, with spreaders locked and all feet contacting a firm level support surface. Feasible abatement would be to ensure that the ladder and employee are on firm and level surfaces while performing satellite dish repair duties.
