Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer did not ensure that forklifts were used in accordance with manufacturer's specifications, as follows: a.At 5000 S Decatur Blvd., Las Vegas, NV, Kwong Yet Lung Co., Inc. employees were using one Hyster and 3 Yale forklifts with a wooden pallet to elevate personnel to heights of 4 to 12 feet above a concrete floor. The manufacturers' operater manual specifically warned against elevating workers on the forklifts unless an ANSI B56.1 compliant work platform was used. Employees elevated on the forklift contrary to manufacturer's warnings were exposed to serious fall injuries. Reference: Yale (m/n NDR030BCNL36TE119, s/n B829N01714U, attachments W/SS ALX CARR and FORKS) Operator Manual p.23: WARNING. Never elevate a worker unless a specially designed work platform is used. The platform must be specially built to meet or exceed the requirements of ANSI B56.1 for elevating platforms. Reference: Yale (m/n NDR035ACNS24TV089, s/n B815N05165Y, side shift and 42" forks) Operator Manual p.23: Same as above. Reference: Yale (partially legible E106VV07370) Operator Manual p.25-26: WARNING. A lift truck is not designed to lift people and may not meet the requirements of ANSI A92.6 for lifting people...If a lift truck is used to elevate a worker, a safety platform must be attached to the forks and carriage. The platform must be specially built to meet or exceed the requirements of ANSI B56.1. Reference: Hyster (m/n N45FR, s/n D138H02027N, side shifter and forks) Operator Manual p.17: WARNING. If a lift truck is used to elevate a worker, a safety platform must be attached to the carriage. The platform must be specially built to exceed the requirements of ANSI B56.1. Feasible Abatement - One feasible means of abatement would be to follow the manufacturer's recommendations as stated in the operator manual.r
