Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard: (a)The hazard of being crushed by materials, at the maintenance facility, where employees used the electrical chain hoist to lift and maneuver various materials, tugboat parts, and machinery. The safety latch which accompanied the hook of the hoist was bent and not serviceable. One feasible and acceptable abatement method, among others, to correct this hazard would to be replace the safety latch to comply with ASME B30.10- 2005, Hooks - Safety Standard for Cableways, Cranes, Derricks, Hoists Hooks, Jacks, and Slings, section 10-1.2.3 paragraphs c and d. (b)The hazard of being crushed by materials, at the maintenance facility, where employees used the chain hoist to lift and maneuver various materials, tugboat parts and machinery. The hoisting I-beam was not rated for a specific capacity. One feasible and acceptable abatement method, among others, to correct this hazard would be to determine the capacity of the I- beam and legibly label the I-beam to comply with ASME B30.16.1998, Overhead Hoist (Underhung), section 16-1.1.1.g),
