Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of struck by: (a)This occurred on or about June 22, 2010, at Highway 73 West, Hampshire, TX where employees were installing reflective markers between the stripes on a two lane highway with traffic moving in the same direction. The employer did not ensure that the distances between the mobile barricades and construction signs followed the traffic control plan there-by exposing the employees to struck by hazards. Among other methods, recognized and feasible means of abatement to correct the hazard include, but are not limited to: (b)The contractor shall provide and train employees to erect barricades and construction signs in accordance with the barricade and construction standard and the "Texas Manual on Uniform Traffic Control Devices at points as shown on the title sheet and plan sheets and as required by the engineer.
